Texas forecloses mostly through the out-of-court (non-judicial) process. Nolo reports the borrower can reinstate within 20 days after the notice of default is served, and there is no redemption after the sale. For investors, short timelines mean pre-foreclosure leads need fast follow-up.

Transfer tax on a sale

No state real estate transfer tax; the Texas Constitution (Art. VIII, Sec. 29) bars any law enacted after January 1, 2016 from imposing a transfer tax on the sale of real property.

Who handles the closing

An attorney is not legally required to close a home sale in Texas.

Seller disclosure when you resell

Mandatory by statute: Texas Property Code 5.008 requires a seller of a single-family home to give the buyer a written seller's disclosure notice, and TREC publishes the Seller's Disclosure Notice form. Plan for it when you resell a property you bought as-is.
