This Refund and Lead Replacement Policy (the "Policy") is incorporated by reference into the Leads Up AI Terms of Service (the "Terms") and the Leads Up AI Lead Purchase Agreement (the "LPA") and forms part of the legally binding agreement between Leads Up AI LLC ("Leads Up AI," "we," "us," or "our") and the Lead Buyer ("you" or "your"). Capitalized terms used but not defined here have the meanings given in the Terms or the LPA.

Overview
We always strive to provide the best quality leads for our Leads Up AI buyers, but unfortunately, invalid leads occasionally fall through the cracks. When this happens, you can return invalid Leads within seven (7) calendar days of receiving them by clicking the "Request Refund / Replacement" button in your Dashboard.
Our team will take the necessary steps to verify your return. The more detail and supporting documents you provide, the faster we can process the request. If a return is approved, we will credit your Leads Up AI Account balance for the price of the Lead, or deliver a replacement Lead matching your bid criteria, at our option. Lead returns are typically processed within five (5) business days.
This Policy is built around verifiable Lead defects. Whether a Lead ultimately converts, responds enthusiastically, decides to sell, or accepts your offer is the work of the Lead Buyer and is not a defect in the Lead. Outcome-based requests, including "no response," "not interested," "not selling," "changed their mind," or "wouldn't agree to my price", are not eligible under this Policy.
1. Final Sale Leads, Non-Refundable
Leads designated "Final Sale" at the time of offering, invoice, or purchase are sold on a non-refundable, non-replaceable, and non-creditable basis. By purchasing a Final Sale Lead, you waive all right to a refund, replacement, credit, or chargeback for that Lead, regardless of outcome. The only exception is willful misconduct by Leads Up AI.
If you are unsure whether a particular Lead is Final Sale, contact us before purchase. Once purchased, the designation is binding.
2. Eligibility Window, Submission, and Form of Remedy
2.1 Window. All refund or replacement requests must be submitted within seven (7) calendar days of the time the Lead is delivered to your Account. Requests submitted after this window are waived.
2.2 How to Submit. Log in to your Leads Up AI Dashboard, locate the "Request Refund / Replacement" button on the applicable Lead, and complete the form. Requests submitted by email, phone, or text in lieu of the Dashboard form are not deemed properly submitted.
2.3 Documentation Required at Submission. All refund and replacement requests must include the required documentation at the time of submission. Requests submitted without supporting documentation will be closed as unsubstantiated and will not be reopened.
2.4 Good-Faith Attestation. By submitting a refund or replacement request, you certify that all information provided is true and complete, that any documentation attached is authentic and unaltered, and that the request is made in good faith. Submission of refund requests based on inaccurate, misleading, or fabricated information constitutes a material breach of the Terms and the LPA and may result in immediate Account termination, clawback of any refunds previously granted, forfeiture of Account balance, and the consequences set forth in the LPA Section 12.
2.5 Form of Remedy. Approved requests are remedied, at Leads Up AI's option, by either (a) a credit to your Account balance equal to the price paid for the Lead, available for future Lead purchases; or (b) delivery of a replacement Lead matching your bid criteria and territory, at no additional cost. Cash refunds to your original payment method are issued only at Leads Up AI's sole discretion or where required by applicable law.
3. Eligible Reasons
A Lead may be eligible for refund or replacement if one of the following applies and is properly documented at submission. These are the only eligible categories.
3.1 Wrong Lead Type
If you receive a Lead where the property type, location, or other bid criteria do not align with the bid the Lead was delivered to.
Examples:
Example 1: You receive a Lead that is actively listed with an MLS number, but your bid was for Single Family Off-Market with High Motivation, that Lead would be eligible for return.
Example 2: You receive a Lead that is a mobile home on a rented plot, but your bid was for Residential Off-Market, that Lead would be eligible for return.
Example 3: You receive a Lead that is in California, but your bid was for Texas, that Lead would be eligible for return.
Required documentation: A link to a current public source (Zillow, MLS, county assessor, or equivalent) showing the property's location, type, or status as of the Lead delivery date.
3.2 Wholesaler Lead
Wholesalers typically have the property under contract for assignment and are not the actual property owners. We will verify that the Lead came from a wholesaler. Please provide any detail you believe is relevant to expedite the process, for example, evidence the submitter is openly marketing the property to other buyers, or is not on recorded title.
Required documentation: Any evidence supporting the wholesaler claim (marketing posts, assignment contracts, title records showing a different owner, or similar).
3.3 Duplicate Lead
If you received more than one version of the same Lead, defined by property address, through Leads Up AI within the prior three hundred sixty-five (365) days, you should return all duplicates aside from the original Lead. Duplicates against Leads sourced outside of Leads Up AI are not eligible.
Required documentation: The Lead ID of the duplicate(s) within your Account.
3.4 Not the Property Owner
The person who submitted the Lead form does not own the property, nor do they have authority to sell the property.
Required documentation: A link to public title or county assessor records showing the current owner of record, or other objective documentation demonstrating the submitter's lack of ownership or authority.
3.5 Invalid Contact Information
The phone number and email listed in the Lead are invalid, and you cannot locate another phone number for the seller. Both the phone number and the email address must independently fail for this category to apply, a Lead with at least one working contact channel is reachable and is not eligible under this Section.
This category also applies where the Lead Name contains profanity, the names of celebrities or historical figures, the property address is a landmark or public property, or the information entered is otherwise nonsensical.
"Invalid" means:
Phone numbers that are disconnected, reach the wrong person (someone with no relationship to the property), or are clearly non-functional; and
Email addresses that hard-bounce, return a non-deliverable response, or otherwise demonstrably fail to deliver.
Soft bounces, full-mailbox responses, "no reply" responses to delivered emails, and "the seller doesn't want to talk to me" responses do not qualify under this Section.
Required documentation: Call logs showing the disposition of each call attempt with timestamps; a screenshot of the email bounce or non-deliverable response; for nonsensical or fabricated Leads, a screenshot of the Lead and any supporting public records.
3.6 Other
If your reason for disputing a Lead is not listed above, please provide supporting documents (call recordings, email and text screenshots, tax records, etc.) and as many details as possible to support why a return should be granted. Without context and documentation, returns submitted as Other will not be reviewed or processed. Requests under this Section are reviewed case by case in Leads Up AI's sole discretion.
4. Our Verification Process
For each request, we verify the claim against public records, MLS data, our own database, third-party data sources, or by direct contact with the submitter where appropriate. The role of our verification is to confirm whether the defect described in the request exists, not to determine whether the seller is still open to selling. Whether the seller is open to receiving offers is the buyer's responsibility to develop through outreach and follow-up.
If the submitter or seller remains in two-way communication with our team or confirms continued interest in selling, that fact does not by itself defeat an eligible claim under Section 3, but the underlying defect (wrong type, wholesaler, duplicate, non-owner, invalid contact) must still be established. Conversely, a seller's later disinterest, non-response, or "no" answer does not create a defect where none exists.
5. Appeals
If a refund or replacement is denied and you believe the denial was in error, you may appeal by emailing leadsadmin@leadsupai.com within three (3) business days of the denial. Include:
the Lead ID;
the original category cited;
a brief explanation of why you believe the denial should be reconsidered; and
any additional documentation not included in the original request.
Appeals submitted after the three-day window will not be reviewed. Appeals submitted without new documentation or new information are unlikely to result in reversal. Appeal decisions are final.
6. Changes to This Policy
We may update this Policy at any time. Updates take effect when posted to the website, and the "Last updated" date will reflect the most recent change. Your continued use of the Services after an update constitutes acceptance.
